Searches & clearance
A search before filing is the cheapest risk reduction in the process. We run identical and similar-mark searches across the Romanian (OSIM) and EU (EUIPO) registers, and assess Madrid designations that take effect in those territories.
What this covers
Knock-out and full searches in the relevant Nice classes; an opinion on registrability (absolute grounds) and on conflict risk (relative grounds); and a recommendation on whether and how to file. Because OSIM does not examine relative grounds, clearance is the practical substitute for office-side conflict checking.
Common questions
- Why search if OSIM does not refuse on earlier marks?
- Precisely because it does not — an unsearched mark can register and still be opposed or later invalidated. A search lets the client decide with the facts.
