What this covers
Opposition against a pending or published application based on earlier rights; invalidity of a registered mark on absolute or relative grounds; and revocation, including for non-use where a mark has not been put to genuine use within the relevant period. We prepare and run the action, or defend against it, and advise on settlement and coexistence.
How we are instructed
Deadlines here are unforgiving — the Romanian opposition window is two months from publication, the EU window three. We confirm the limit on receipt and advise on the strength of the position before the cost is incurred.
Common questions
- What are the opposition deadlines?
- Two months from publication in BOPI for a Romanian mark; three months from publication for an EU trade mark. Both run from publication and are not extendable, so the date must be confirmed on receipt.
- Can a registered mark still be challenged?
- Yes — by invalidity, on absolute or relative grounds, or by revocation, including for non-use where the mark has not been put to genuine use within the relevant period.
