International trade marks (Madrid)
The Madrid System lets a holder extend a single international registration to many territories. Romania and the European Union can both be designated. We act as local counsel on those designations.
What this covers
Advice on designating Romania and/or the EU; monitoring of the designation through OSIM or EUIPO examination; and — the work most often needed — responding to any provisional refusal issued against the designation (see Provisional refusals).
The procedure
Each designated office examines the designation under its own law and either grants protection or issues a provisional refusal within the applicable period. A response is filed directly with the office that issued the refusal, not with WIPO. To contest a refusal, the holder must appoint a local representative — which is where we are instructed.
How we are instructed
Send the WIPO notification; we calendar the deadline, confirm the requirements of the office concerned, and report a route before the window closes.
Common questions
- Do you need a local representative just to be designated?
- No — only to contest a provisional refusal before OSIM or the EUIPO. Until then the designation proceeds without local representation.
