Choosing the right forum
Domain recovery turns on where the name sits. For generic top-level domains the route is the UDRP — a fast, documents-only procedure before an approved provider such as WIPO. For .ro, WIPO administers an equivalent service under the dedicated .RO policy, and a complainant may instead go to the Romanian courts, which, unlike the UDRP, can award damages. The .eu space has its own ADR procedure. We advise on which forum fits the facts and the commercial aim.
A domain is part of the brand
A domain dispute is rarely only about a domain. We coordinate the action with the underlying trade mark — securing or asserting the mark, addressing any parallel social-media or marketplace abuse, and timing the domain claim so it supports, rather than cuts across, the wider enforcement.
How we work
- Assess the registration and use — who holds the name, whether in bad faith, and what right you can assert.
- Choose the forum — UDRP, the WIPO .ro service, .eu ADR, or the Romanian courts — for the speed, cost and remedy you need.
- Act — file and run the complaint, or send pre-action correspondence where that resolves it faster.
- Coordinate with the trade mark, copyright and any marketplace or social-media action.
Common questions
- Does the UDRP apply to .ro domains?
- WIPO runs a dispute-resolution service for .ro under a dedicated, UDRP-based .RO policy. It is close to the standard UDRP, with one difference: a complainant may rely on a trade mark or on a geographical indication protected in Romania or the EU. The alternative is the Romanian courts.
- Can I get damages for cybersquatting?
- Not through the UDRP or the WIPO .ro service, which can only transfer or cancel the name. Damages require court proceedings — in Romania, on a trade mark or unfair-competition basis — which we can pursue where the loss justifies it.
- Do I need a Romanian trade mark to recover a .ro domain?
- Not necessarily — an EU trade mark covering Romania can be enough, and the .ro policy also recognises protected geographical indications. We confirm the best right to rely on before filing.
