OSIM examines a Romanian trade mark application on absolute grounds only. It does not refuse on the basis of earlier marks — those are raised by opposition, within two months of publication in BOPI.
The consequence is simple: an unsearched mark can register and still be opposed or later invalidated. A search before filing is the cheapest risk reduction in the process — it lets the client decide with the facts.
