When an international registration designates Romania or the European Union, OSIM or the EUIPO examines that designation under its own law. If there is an objection — absolute grounds, an earlier right, an opposition or a formality — the office issues a provisional refusal: a notice of grounds with a deadline to respond.

Respond to the office, not to WIPO

The response is filed directly with the office that issued the refusal. WIPO forwards the notice, but it does not handle the substantive reply. To contest the refusal, the holder must appoint a local representative before OSIM or the EUIPO.

The deadline is the point

The response period is fixed by the office concerned and is often short. A missed deadline means the designation is refused — wholly or in part — in that territory, frequently with limited recourse.

What we need to start

  • The WIPO notification or office action.
  • The international registration number.
  • A power of attorney (a scan is enough to begin).

We acknowledge on receipt, calendar the deadline to the day, and report a clear route before the window closes. See our provisional refusals service for how we run these.
